If you have not signed a gas lease you are encouraged to attend an informational meeting on Tuesday, November 11th from 7pm to 8:30 pm at New Bethel Church (located on Collins St., just Northwest of the intersection at Sublett).
If you know of anyone in the SEACTX area that has not signed a gas lease, please pass this information on to them.

Hope everything is fine with you. Since I really have not heard of anybody, I am assuming the people that stay with us to the end got the ‘better deal’ we worked so hard for.
I am sure that everybody that signed with us (SEACTX lease) is somewhat happy. But what about the people that signed with somebody else? There might be good news. I contacted a lawyer who is willing to hear what we experienced during our ordeal.
Do you feel that you have been deceitfully ‘tricked’ into a contract? Do you feel you were lied too? Do you know of what you would call unprofessional behavior on the part of the leasing companies? Have people stalked you during the processes of getting your lease? Did you sign for less than your neighbor although the leasing company was the same?

BTW, I (Tom Lerch), signed with XTO this past weekend for a much better signing bonus and contract. I got the better deal - how about you? For all who signed with POSAR/SEACTX, the signing parties will move much quicker now. Please be patient as you will be part of it (if you signed up with us)…

I wonder what type of misrepresentations be applicable to landbrokers we have operating in our area.
- “We already signed everybody from that neighborhood.”
- “You do not have the numbers to dictate terms.”
- “They are all liars. We tell the truth.”
- “We have drill sites on M/H and behind W.”
- “This offer will only be valid until xx/xx/xx. You will not have a chance to sign after that.”
- One letter showed “they” had x % of subdivision leased and the very next letter shows y % (which was less than x %).
Anybody have any other types of comments…
This is an e-mail from SEACTX. Please read carefully as Wyldfire/HRS are at it again. Remember, they are not permitted to drill in Arlington, but yet make you believe they have drill sites here that will be able to get the minerals of everybody. It would be greatly appreciated if someone could present me with permits of HRS here in Arlington!
“Dear residents,
You may be receiving a letter from Hollis Sullivan soliciting you with manipulated information by mail in the next few days. They attach an update of mine to this information, that was mistakenly placed in a neighborhood blog. Although it is true that XTO will not be drilling in that area, what they do not bother to inform you, is that they DO NOT NEED to be the driller for you to receive an outstanding contract, that has been promised to you by XTO. The only risk involved in signing the XTO lease, is that if Chesapeak does not purchase the contract from XTO, then you would not receive royalty. However, here is what makes that an impossiblity . The fact that Chesapeak is pushing even harder to get you, means they HAVE to have your lease in order to drill on that drill path, so they will buy it from XTO to have what they need to drill. So now you can feel safe in receiving the XTO lease. Further, I have attached some more information that followed that update within SEACTX to better help you understand the email they attached.
First off, the email you received titled SEACTX 6/10/08 Update, was from me, Jalise Middleton. SEACTX is having difficulty finding a mass email system large enough to carry our groups email accounts. This has forced me to start reaching out in other ways to inform our residents of what is happening in SEACTX.
Second, I am getting a large amount of email, as are your neighborhood spokesman, with residents fearful that they will not receive the offer from XTO. THIS IS NOT TRUE! All SEACTX residents will be given the negotiated lease offer from XTO. They have given us their word in writing. My email clearly stated the royalty could become a concern if Chesapeake does not buy the leases from XTO in the “low ratio” subdivisions. However, I consider this risk minimal (and still better than what you were being offered by Chesapeak) It is a minimal risk for your area because Chesapeake will need them in order to drill, therefore, they will need to buy them from XTO.
I simply sent the email to be forthcoming with any information I had, so residents understood all the risk, and options. But really nothing has changed. Please reread the update many times to gain understanding, and rest assured that you are part of SEACTX, and XTO has accepted SEACTX, which means they have accepted you! Following are some steps that were provided by SEACTX.
Step 1: Receiving the Post Card
Soon, you should receive a postcard in the mail from XTO Energy. A picture of the postcard can be seen at http://www.seactx.org. On the back side it should have summary information on our lease terms and contact information for Permian Land Company which is the company that will be conducting our lease signing for XTO. Not all residents will receive the post card on the first round. Please be patient.
Step 2: Contacting Permian Land Company
If you want to sign the XTO lease here’s what you need to do to get things started:
- Review the personal information on the card for accuracy.
- Review the lease highlights printed on the form and make sure they match the SEACTX negotiated contract amounts posted on www.seactx.org
- Contact Permian Land Company at the phone number or email address on the post card. Tell them that you have received the postcard and want to sign the lease (assuming you do).
- Inform Permian of any errors on your card.
- If you live outside of the DFW area you should inquire at this time as to how your lease signing will be handled.
- Request a W-9 form from Permian.
Step 3: Submitting the IRS W-9 Form.
To expedite the lease signing process and the process of receiving your bonus check, you will need to fill out a W-9 (”Request for Taxpayer Identification Number)” form. Permian can email you this form or send it by U.S. mail. The form is also available from the IRS at www.irs.gov . This form is required so that the leasing company can report to the IRS the bonus payment and any royalty payments paid to you. Fill out the W-9 form and return it to Permian at the U.S. mail address, email address, or fax number provided on the post card.
Note: Failure to provide the W-9 tax form may delay your signing and receipt of your bonus check.
Step 4: Reviewing the Lease
While you are waiting to hear back from Permian, print out a copy of the lease and read it. If you want to have an attorney review it, this is probably a good time to do that. Remember that SEACTX negotiated this lease on our behalf but each resident is responsible for reviewing and understanding the lease before they sign it. Remember that the lease is between you and XTO Energy.
Step 5: Acknowledgement Package/Notice.
Once Permian has received your W-9 form they should complete the mineral rights research and begin preparation of your contract and bonus check. Permian should then mail you a package that contains all the information you need to know about the signing party… The package should tell you the location, date, and time of the signing and list any paperwork you will need to provide.

All the postcard does, is trigger a W-9 link to be emailed to you that looks like the following letter. Dear Homeowner/Mineral owner,
Thank you for your recent response to our mail out. Please take a moment to fill out the W9 we have attached and return it to our office at your earliest convenience. You may choose to fax it to (817) 334-0146, or mail it to P.O.. Box 1226, Fort Worth, TX 76101. Make sure to put your full name and address on the W9 to ensure proper filling. Also, it is very important that you remember to sign it. If you are married, it is not necessary for both of you to sign this document. However, you will both need to sign the lease.
Once we receive your W9, we will then begin to prepare your lease and bonus check. At that time, we will notify you (via post card) of the date and time of when and where the signing party will be. There you will be asked to sign your lease in exchange for your bonus check. If for any reason you are unable to attend a lease singing party, please notify our office at the time of your invitation so that we may schedule an appointment that better suits your needs.

Following is an excerpt from a SEACTX e-mail.
“Now that we have secured a deal, the next step is signing parties. We are believed to be the largest group to go to the table and coordinating this effort for several thousand families has been quite an undertaking. XTO has arranged with Permian Land to handle our signing parties. They are in the process of confirming mineral rights for all of the subdivisions.
POSTCARD
Permian will be sending out a postcard to everyone in the SEACTX area that has not signed a lease. This is to make sure that everyone, whether they officially joined or not, is given the opportunity to sign. This will also let us and Permian know which homes to make up packets for.
When you receive the postcard (a sample is on the www.seactx.org website), PLEASE CALL OR EMAIL TO REQUEST A W-9 FORM. This will help Permian keep track of everyone who intends to sign the SEACTX deal and print up leases/checks accordingly. If you don’t respond, they won’t have a lease/check waiting for you when you go to sign, and it will seriously delay the process for your family.
LEASE
XTO intends to file a memorandum of lease in the public record. What does this mean? It means that the details of the lease remain private on the public record, so it’s very important that you keep a copy of the lease for your files. We will insist that you receive a copy of the lease at the signing party; do not sign the lease unless Permian is able to make copies at the signing party! Otherwise, you won’t have a record of what you officially signed.”
To get the final lease, please contact your neighborhood contacts/street representatives.
“Please print this out, read it, and contact an attorney if you have any questions about it. Understand what you are signing before you sign. This is a long term commitment for your family. Bring a copy of the lease with you to the signing party and make sure that the lease they present for your signature is IDENTICAL to the language in the one we sent you. Other groups have been victims of the “bait and switch”; we want to safeguard against that happening to us, too. Anyone listed on the title of the home must sign the lease for it to be valid. You may be asked to bring copies of your home’s documents, such as title, deed, plat, etc.
SIGNING PARTIES
The signing parties will be arranged based on subdivision or HOA; then there will be open dates for folks who belong to those communities that were not able to make it on the “regular” days. Please don’t try to sign before your subdivision is called; they may not have your documents on hand and you will have wasted your time.
