Following are some steps that were provided by SEACTX. 

Step 1: Receiving the Post Card

Soon, you should receive a postcard in the mail from XTO Energy. A picture of the postcard can be seen at http://www.seactx.org.  On the back side it should have summary information on our lease terms and contact information for Permian Land Company which is the company that will be conducting our lease signing for XTO. Not all residents will receive the post card on the first round. Please be patient.

Step 2:  Contacting Permian Land Company

If you want to sign the XTO lease here’s what you need to do to get things started:

  • Review the personal information on the card for accuracy.
  • Review the lease highlights printed on the form and make sure they match the SEACTX negotiated contract amounts posted on www.seactx.org
  • Contact Permian Land Company at the phone number or email address on the post card. Tell them that you have received the postcard and want to sign the lease (assuming you do).
  • Inform Permian of any errors on your card.
  • If you live outside of the DFW area you should inquire at this time as to how your lease signing will be handled.
  • Request a W-9 form from Permian.

Step 3: Submitting the IRS W-9 Form.

To expedite the lease signing process and the process of receiving your bonus check, you will need to fill out a W-9 (”Request for Taxpayer Identification Number)” form.  Permian can email you this form or send it by U.S. mail. The form is also available from the IRS at www.irs.gov . This form is required so that the leasing company can report to the IRS the bonus payment and any royalty payments paid to you. Fill out the W-9 form and return it to Permian at the U.S. mail address, email address, or fax number provided on the post card.

Note: Failure to provide the W-9 tax form may delay your signing and receipt of your bonus check.

Step 4: Reviewing the Lease

While you are waiting to hear back from Permian, print out a copy of the lease and read it. If you want to have an attorney review it, this is probably a good time to do that. Remember that SEACTX negotiated this lease on our behalf but each resident is responsible for reviewing and understanding the lease before they sign it. Remember that the lease is between you and XTO Energy.

Step 5: Acknowledgement Package/Notice.

Once Permian has received your W-9 form they should complete the mineral rights research and begin preparation of your contract and bonus check. Permian should then mail you a package that contains all the information you need to know about the signing party… The package should tell you the location, date, and time of the signing and list any paperwork you will need to provide.

If you are interested in bypassing the postcard fiasco, feel free to simply follow this link: http://www.seactx.org/fw9.pdf and follow the directions below EXACTLY. All the postcard does, is trigger a W-9 link to be emailed to you that looks like the following letter. Then, when you get the postcard, if you have already mailed in the W-9, you do not need to respond to the postcard.

Dear Homeowner/Mineral owner,

Thank you for your recent response to our mail out. Please take a moment to fill out the W9 we have attached and return it to our office at your earliest convenience. You may choose to fax it to (817) 334-0146, or mail it to P.O.. Box 1226, Fort Worth, TX 76101. Make sure to put your full name and address on the W9 to ensure proper filling. Also, it is very important that you remember to sign it. If you are married, it is not necessary for both of you to sign this document. However, you will both need to sign the lease.

Once we receive your W9, we will then begin to prepare your lease and bonus check. At that time, we will notify you (via post card) of the date and time of when and where the signing party will be. There you will be asked to sign your lease in exchange for your bonus check. If for any reason you are unable to attend a lease singing party, please notify our office at the time of your invitation so that we may schedule an appointment that better suits your needs.

 Following is an excerpt from a SEACTX e-mail.

Now that we have secured a deal, the next step is signing parties. We are believed to be the largest group to go to the table and coordinating this effort for several thousand families has been quite an undertaking.  XTO has arranged with Permian Land to handle our signing parties. They are in the process of confirming mineral rights for all of the subdivisions.

POSTCARD

Permian will be sending out a postcard to everyone in the SEACTX area that has not signed a lease. This is to make sure that everyone, whether they officially joined or not, is given the opportunity to sign. This will also let us and Permian know which homes to make up packets for.

When you receive the postcard (a sample is on the www.seactx.org website), PLEASE CALL OR EMAIL TO REQUEST A W-9 FORM. This will help Permian keep track of everyone who intends to sign the SEACTX deal and print up leases/checks accordingly. If you don’t respond, they won’t have a lease/check waiting for you when you go to sign, and it will seriously delay the process for your family.

LEASE

XTO intends to file a memorandum of lease in the public record. What does this mean? It means that the details of the lease remain private on the public record, so it’s very important that you keep a copy of the lease for your files. We will insist that you receive a copy of the lease at the signing party; do not sign the lease unless Permian is able to make copies at the signing party! Otherwise, you won’t have a record of what you officially signed.”

To get the final lease, please contact your neighborhood contacts/street representatives.

Please print this out, read it, and contact an attorney if you have any questions about it. Understand what you are signing before you sign. This is a long term commitment for your family.  Bring a copy of the lease with you to the signing party and make sure that the lease they present for your signature is IDENTICAL to the language in the one we sent you. Other groups have been victims of the “bait and switch”; we want to safeguard against that happening to us, too.  Anyone listed on the title of the home must sign the lease for it to be valid. You may be asked to bring copies of your home’s documents, such as title, deed, plat, etc.

SIGNING PARTIES

The signing parties will be arranged based on subdivision or HOA; then there will be open dates for folks who belong to those communities that were not able to make it on the “regular” days. Please don’t try to sign before your subdivision is called; they may not have your documents on hand and you will have wasted your time.

As stated on the web site(s), XTO will be sending out postcards to our members.  Following is an e-mail from SEACTX:

“Dear Neighborhood organizers, and street reps,

We have had to allow XTO to send postcards in the mail to all SEACTX coverage area, including all the SEACTX members. This card, as I am sure you are aware, has to be signed, and retu[rn]ed immediately. Many of your residents have heard us say many times not to sign anything that comes in the mail, or at their door. Now we are contradicting ourselves, and stating otherwise. We need to make sure the word gets out to all our residents. This is a special conce[rn] for those that did not release an email address to us. I can pull that information for whoever needs it. These residents will need a phone call, or visit to their home to tell them to look for this postcard, and to sign and retu[rn] it. Tell them they can verify this information from the website. If you are conce[rn]ed for time, and don’t want to get caught up on the phone, I suggest calling during the day, and leaving a message.Thank you all for all you have done for SEACTX! Just a little further to go!

Please check out the SEACTX web site www.seactx.org for detailed information regarding the mailer as well as the signing parties.  REMEMBER, sign only during official signing parties organized by POSAR and SEACTX.

Please note that XTO/Permian will send out postcards and packages.  I have taken of the previous post from Permian as it looks like the whole thing was a misunderstanding.

Signing parties are being organized as we speak.  DO NOT SIGN WITH ANYBODY BUT SEACTX!!!  POSAR and SEACTX leaders will be at the signing parties.  Please be patient – we do have a contract.  Also, it looks like the Oil & Gas Leases are getting more popular to our news media.  The Star Telegram has two reports you might be interested in.  Please check them out below.

By the way, I learned an interesting tidbit this week.  It looks like Hollis R Sullivan is paying the neighbors working on their behalf after all.  I asked the team lead over there multiple times between November (2007) and March (2008) – he always stated that they are doing it ‘out of the goodness of their hearts.’  Well, how does 12 percent payoff sound?
